These Terms (the "Agreement") govern the use of MiHosting.com services. By contracting or using any service you accept this Agreement. If contracting on behalf of a company, you declare that you have sufficient authority to bind it.

1. Incorporated documents

The following documents form an integral part of this Agreement (in their current version):

  • Privacy Policy (data protection and cookies)
  • Acceptable Use Policy (AUP)
  • Uptime SLA and network SLA by service type (shared, VPS/Cloud, dedicated)
  • Domain-specific terms (ICANN/registries), SSL certificates, third-party software licences and any current technical limits annexes
  • Any other document that MiHosting.com expressly indicates as part of the service

In the event of conflict, this Agreement prevails; for SLA matters, the SLA prevails within its scope.

2. Essential definitions

  • Customer: the individual or legal entity contracting services.
  • Services: hosting (shared, reseller, VPS/Cloud, dedicated), email, domain registration/transfer/renewal, SSL certificates, migrations and other ancillary services.
  • Control Panel: the client area and technical panels (cPanel/DirectAdmin or others).
  • AUP: Acceptable Use Policy.
  • Customer Content: data and files hosted or transferred by you using the Services.

3. Account registration and eligibility

  • You must be at least 18 years of age. If acting on behalf of a company, you warrant that you have sufficient authority to bind it.
  • You undertake to provide accurate and current information, including an operational email address not hosted on the contracted service itself.
  • MiHosting.com may require identity or payment verification (e.g., official documentation). Failure to provide it may result in order cancellation.

4. Order, provisioning and service changes

  • The service is provisioned following payment confirmation and anti-fraud validation.
  • MiHosting.com may reject orders that are reasonably suspected of being fraudulent or incompatible with the AUP.
  • Plan changes (upgrades/downgrades) will be prorated according to current rules; some downgrades may take effect from the next billing cycle.

5. Billing, taxes and renewals

  • Prepaid for the contracted billing cycle. Renewals are automatic unless a cancellation is requested via the Control Panel.
  • Taxes (e.g., VAT) are applied in accordance with applicable law and the Customer's location.
  • MiHosting.com may adjust prices or resources; material changes will be communicated with reasonable advance notice for the next renewal period where required by law.
  • Domains: renewal notices may be issued up to 30 days before the expiry date. Non-payment results in non-renewal.

6. Non-payment, suspension and deletion

If an invoice remains unpaid for more than 7 days past the due date, MiHosting.com may suspend the affected service.

Deletion for non-payment

  • Shared / Reseller / Email / Website Builder: after 15 days of suspension.
  • VPS / Dedicated: after 7 days of suspension.

Services suspended for any reason will be deleted if the necessary corrective actions are not taken. Once an account or server is deleted, data recovery cannot be guaranteed. MiHosting.com may charge reasonable reconnection or non-payment management fees.

7. Money-back guarantee (shared hosting)

MiHosting.com offers a money-back guarantee of up to 365 days, exclusively for shared hosting plans. This guarantee does not apply to reseller, VPS/Cloud, dedicated or any other services.

Exclusions — non-refundable in all cases

  • Domain names (registration, renewal, transfer) and registry fees.
  • SSL certificates.
  • Third-party licences or software (builders, antivirus, external backups, CDN, etc.).
  • Services already rendered or technical work (migrations outside the courtesy period, custom support interventions, audits, on-demand restorations).
  • VPS/Cloud and dedicated servers, additional IP addresses, one-off resource upgrades and administrative charges.

Refund calculation (shared hosting only)

The refund is calculated on a straight-line basis for the unconsumed time in the current billing cycle, using the list price of the plan at the time of purchase (excluding discounts, coupons or free months) as the base, minus:

  • Days used, valued at the daily list price.
  • Non-refundable amounts listed above.
  • Irrecoverable bank fees and taxes effectively remitted where the law does not permit their refund.

If the contracting included discounts or promotions, these apply only to the portion already enjoyed; the remainder is calculated at the list price. The refund amount shall not exceed the amount effectively paid for the shared hosting component of the current billing cycle.

Refund method

Where possible, refunds will be made to the original payment method (card/PayPal). If the original method does not support refunds or the payment provider's operational deadline has passed, the refund will be issued as account credit at MiHosting.com or via bank transfer to the same account holder.

This guarantee does not affect consumer rights under applicable law, including the right of withdrawal in distance contracts (see Clause 8).

8. Right of withdrawal (EU consumers) and exceptions

EU consumers have 14 calendar days from the date of contracting to withdraw from a distance contract without giving any reason. Exceptions: where the service has commenced with the Customer's express consent and with the knowledge that the right of withdrawal is thereby lost (e.g., immediate hosting activation, domain registration/renewal/transfer, SSL issuance), the right of withdrawal shall not apply.

MiHosting.com implements express consent checkboxes and email confirmations during the signup process.

9. Cancellation by the Customer

The Customer may cancel via the Control Panel up to 24 hours before the next renewal date. Cancellation triggers data deletion when processed; it is the Customer's responsibility to download their own backup copies beforehand. The money-back guarantee (Clause 7) will apply where eligible.

10. Termination by MiHosting.com

MiHosting.com may terminate or restrict the service, in whole or in part and without prior notice, if: (i) there is non-payment; (ii) breach of this Agreement or the AUP; (iii) risk to the security or stability of the platform; (iv) authority request; (v) unlawful use or damage to third parties. In such cases, no refund will be made for amounts already accrued.

11. Migrations

Migrations are offered as a courtesy during the first 4 weeks after signup, subject to technical eligibility (formats, access credentials, size). Timeframes and complete success cannot be guaranteed. It is the Customer's responsibility to maintain their own backup copies before and after the migration.

12. Service Level Agreement (SLA)

Shared / Reseller

Uptime target: 99.9% monthly. Credits for verified downtime:

  • 99.8% – 99.0% → 5% of the monthly fee
  • 98.9% – 95.0% → 10%
  • 94.9% – 90.0% → 20%
  • < 90.0% → 30%

Excludes: scheduled maintenance, Customer's ISP outages, Customer's software failures, force majeure, urgent security measures and suspensions for non-compliance.

VPS / Dedicated

Covered by the network SLA of the corresponding data centre. Credits are governed by that specific SLA.

Credit requests

Via support ticket within 15 days of the incident. Third-party monitoring tools do not constitute conclusive evidence.

13. Resources, fair use and backups

Use is subject to the AUP and current technical limits (CPU/RAM/IO, processes, MySQL queries, cron jobs, etc.).

Inodes: each file or folder consumes 1 inode. Accounts exceeding 100,000 inodes may be excluded from automatic backups.

MiHosting.com backups are best-effort and do not replace your own copies. Restorations cannot be guaranteed if the inode or storage limit is exceeded, or the account is suspended.

14. Email and anti-spam

Sending unsolicited email or using lists without verifiable consent is prohibited; purchasing or renting email databases is also prohibited.

Minimum requirements: valid SPF and DKIM records; DMARC recommended; a clear unsubscribe link in commercial messages and proper bounce and complaint management.

If your sending causes RBL listings or impacts shared IP reputation, MiHosting.com may block sending, require corrective measures and charge reasonable remediation costs.

15. Security and Customer responsibilities

The Customer is responsible for the secure configuration of their services (file permissions, strong passwords, software updates). MiHosting.com may perform security audits and require changes. Unauthorised access to third-party systems is prohibited; any abuse may result in immediate suspension.

16. Customer content and limited licence

You retain ownership of Customer Content. To provide the service, you grant MiHosting.com a non-exclusive, royalty-free licence to host, transmit, copy and back up the content, and to perform the technical actions necessary for service delivery (caching, replication, backup).

Hosting unlawful, infringing or CSAM material is prohibited (zero tolerance). See the Acceptable Use Policy.

17. Third-party products and services

MiHosting.com may resell or licence third-party products (licences, website builders, antivirus software, etc.). Those products are governed by their own terms. MiHosting.com is not liable for their performance beyond what is provided by law and this Agreement.

18. Export controls and international sanctions

You declare that you are not a sanctioned person or entity, nor resident in territories subject to international sanctions, and that you will not use the Services for purposes prohibited under export control regulations (EU/USA).

19. Domains — summary

MiHosting.com acts as an agent between registrars and registries. Domain allocation depends on registry policies and is not guaranteed. You must maintain accurate registrant data and comply with required verification processes.

Upon expiry, some TLDs allow a grace period or redemption period with registry-specific restoration fees; MiHosting.com will pass on such fees accordingly. Domains are non-refundable. See the Domain Terms.

20. Resellers

The reseller is responsible for compliance with this Agreement and the AUP by their end customers. Violations or repeat offences may result in suspension or termination of the reseller service.

21. Data protection

MiHosting.com processes data in accordance with its Privacy Policy and GDPR/LOPDGDD regulations. The Customer is responsible for the processing of data contained within the Customer Content they host.

22. Maintenance, changes and force majeure

MiHosting.com may perform maintenance tasks without a fixed maintenance window or prior notice, always seeking to carry them out during the lowest-traffic period for each server. MiHosting.com may take immediate action in response to critical security incidents without prior notice. MiHosting.com is not liable for force majeure events or circumstances beyond its reasonable control.

23. Amendments to this Agreement

MiHosting.com may update this Agreement at any time. Where a change is material, it will be communicated by reasonable means (Control Panel notice or email) with reasonable advance notice where applicable. Continued use of the service after the effective date constitutes acceptance of the updated terms.

24. Governing law and jurisdiction

This Agreement is governed by Spanish law. Except where mandatory law provides otherwise, the parties submit to the exclusive jurisdiction of the courts and tribunals of Madrid (city).

25. Miscellaneous

  • Assignment: the Customer may not assign this Agreement without MiHosting.com's prior written consent.
  • Severability: the invalidity of any clause shall not affect the remainder of this Agreement.
  • Entire agreement: this Agreement and the referenced documents constitute the entire agreement between the parties.

Annex A — Service Level Agreement (shared/reseller)

  • Objective: 99.9% monthly uptime, measured at the server's network layer.
  • Credits: 5% / 10% / 20% / 30% of the monthly fee according to downtime thresholds (see Clause 12).
  • Exclusions: scheduled maintenance, force majeure, Customer errors, AUP suspensions, Customer's ISP outages, etc.
  • Procedure: support ticket within 15 days of the incident; credits are applied as account balance.

Annex B — Technical limits (indicative)

  • CPU/RAM/IO: sustained use must not exceed 25% of server resources for periods of 90 seconds or more.
  • Concurrent processes: maximum 25 per account.
  • Cron jobs: minimum interval of 15 minutes.
  • MySQL: maximum query execution time of 15 seconds.
  • Inodes: exclusion from automatic backup above 100,000 inodes.

Annex C — Website Builder / Online Store

A service designed for basic use under shared hosting standards: pre-designed templates, reasonable limits on pages, products and bandwidth under a fair use policy. Integrations with payment gateways and third-party services are subject to their own terms.

Content or activities prohibited by the AUP are not permitted (spam, sustained IPTV/streaming, mining, sale of illegal products, etc.). The Customer is responsible for complying with applicable sector regulations (e-commerce, VAT, pre-contractual information, data protection) and for configuring their own sales and returns policies.
